West Beach Permit Terms and Conditions - Please read and check the box below.

1.  A permit fee of three hundred dollars ($375.00) per vessel shall be charged to place an outrigger, sailing outrigger, sailboat, rowing dory, or surf ski within the area designated by the Harbormaster on West Beach. Outriggers and rowing dories shall be no longer than forty-five (45) feet nor wider than seven (7) feet. Sailing outriggers shall be no longer than forty-five (45) feet nor wider than eighteen (18) feet. Sailboats shall be no longer than sixteen (16) feet overall nor wider than six (6) feet. Permits shall be sold on an annual basis beginning on the second Friday of March. No vessel may be stored on West Beach at any other location and no vessels other than those permitted by the Harbormaster may be placed on West Beach.

A maximum of fifty-one (51) permits shall be issued each year, divided as follows:

  • A combined maximum of 20 permits for sailboats and rowing dories.
  • A maximum of 2 permits for sailing outriggers, convertible to outrigger permits if unassigned by March 31st  of any permit year.
  • A maximum of 28 permits for outriggers and surf skis.
  • A maximum of one tomol permit.

No permit is valid unless proper application is made to the Harbormaster and the permitted vessel displays a valid permit sticker in addition to current California registration numbers if required. No commercial activities shall be conducted. Permits are non-transferable and non-refundable.

2.  A $20 per day storage fee shall be charged for any unpermitted vessel or item removed from Leadbetter Beach or West Beach by Waterfront Department staff.

3.  The outrigger/sailboat/dory shall be stored on West Beach in a location specifically designated by the Harbormaster. A portable storage box for outrigger equipment may be placed in the immediate vicinity of the rock groin. The Harbormaster reserves the right to order removal of boxes not sized, configured or placed in a manner conforming to the intent of this permit. The area of training activity shall be the waterway defined as north of the marked harbor entrance channel, east of the rock groin, and west of Stearns Wharf. The second area of activity shall be defined by the buoyed harbor entrance channel for the purpose of open sea access.

4.  Complaints received by the City regarding excess noise generated or excess equipment boxes placed by outrigger, sailboat or dory-related activities will be forwarded to the club representative (or appropriate person) for correction. Failure to comply with a request to control a nuisance will be grounds for discontinuation of permission to operate in the defined area of the harbor and store the vessel on West Beach.

5.  The owner(s) shall assume all risk of damage or loss of any kind to his/her property while it is within the limits of the harbor district. The City assumes no risk on account of fire, theft, act of God, sea conditions, or damages of any kind to vessels.

Indemnity Agreement

West Beach Permittee, on behalf of him or herself and his or her heirs, executors and administrators and invitees, shall investigate, defend, indemnify and hold the City and the respective officers, agents and employees of the City harmless from and against all liabilities, obligations, damages, penalties, claims, costs, charges and expenses (including reasonable attorneys’ fees) by reason of injury or death of any person, or damage to or destruction of any property which may be imposed upon, incurred by or asserted against the City, or the respective officers, agents and employees of the City arising out of or in any way connected with the West Beach Permit or the use or enjoyment of the Santa Barbara Harbor by the West Beach Permittee or invitees of the Permittee.

West Beach Permittee hereby releases, waives, discharges and covenants not to sue the City of Santa Barbara, its employees, officers, and agents (hereinafter referred to as “releasees”) from all liability to West Beach Permittee, his or her personal representatives, assigns, heirs, next of kin and invitees for any loss, damage, or claim therefore on account of injury to the person or property of West Beach Permittee or Permittee’s invitees, whether caused by any negligent act or omission of the releasees or otherwise while the West Beach Permittee or invitees of the Permittee is engaged in any way with the use or enjoyment of the Santa Barbara Harbor District.

West Beach Permittee acknowledges that other than the issuance of a West Beach Permit to Permittee for Permittee’s use of the Harbor pursuant to the permit, no representation of fact or opinion has been made by the City of Santa Barbara or any of its respective officers, employees or agents, to induce this release, and that West Beach Permittee has signed this release freely and voluntarily, after having read it completely, and with full knowledge of any rights or privileges that West Beach Permittee may be waiving or releasing.

I understand and agree to obey and cause to be obeyed the above regulations and indemnity agreement. I understand that permittees who fail to comply with the permit regulations as established by the City or any other ordinances or laws will immediately have their permit revoked without recourse.
